1. Ownership of Proprietary Materials
Unless otherwise agreed in writing, all methodologies, workflows, templates, frameworks, automation logic, configurations, scripts, technical documentation, optimisation systems, advertising structures, and supporting materials developed by Webbuilder are the intellectual property of Webbuilder or its associated entity, Esterhuizen Consulting & Coaching (ECCSA).
This includes, but is not limited to:
Development frameworks
SEO configurations
Google Ads account structures
Automation workflows
Technical system designs
Website configuration methodologies
Documentation and training materials
No ownership rights are transferred to clients unless expressly agreed in writing.
2. Website Code, Structures & Licensing
Website layouts, configurations, templates, structural elements, and system configurations created by Webbuilder are licensed to the client for use on their own website.
Such materials may not be:
Reused on other domains
Resold
Distributed
Sublicensed
Reverse engineered
Commercially exploited
without prior written consent.
3. Third-Party Software & Tools
Websites and platforms developed or maintained by Webbuilder may incorporate third-party software, including but not limited to:
WordPress
WooCommerce
Elementor
Hosting platforms
Security tools
Optimisation tools
Analytics services
Payment gateways
AI tools
All third-party software remains the intellectual property of its respective owners and is governed by its own licensing terms.
Use of such tools does not transfer ownership or independent licensing rights to the client.
4. Professional & Premium Licences
Where Webbuilder or ECCSA utilises proprietary, professional, or enterprise licences for plugins, themes, builders, or security tools:
Such licences remain the property of Webbuilder/ECCSA.
Clients are granted a limited, non-exclusive, non-transferable right of use.
Upon termination, migration, or cessation of support, licences may be withdrawn unless the client obtains their own licence.
5. AI-Assisted Deliverables
Where artificial intelligence tools are used to assist with development, optimisation, diagnostics, or content support:
Deliverables are limited to the agreed scope.
No ownership rights are transferred in underlying AI models, systems, workflows, or proprietary optimisation logic.
6. Client Content
All content supplied by clients remains the property and responsibility of the client or their licensors.
Clients warrant that they hold all necessary rights, permissions, and consents to use such content.
Webbuilder shall not be liable for infringement or misuse of client-supplied materials.
7. Enforcement
Unauthorised copying, reproduction, redistribution, or exploitation of Webbuilder intellectual property may result in legal action.
