1. Nature of Hosting Services
Webbuilder facilitates website hosting using third-party hosting providers and infrastructure.
Webbuilder does not own, operate, or control:
Servers
Data centres
Cloud platforms
Network infrastructure
Hosting services are dependent on third-party providers.
2. No Guaranteed Uptime
Hosting and availability are provided on a best-effort basis.
No guaranteed uptime percentage, response time, or performance metric applies unless expressly agreed in a separate written SLA.
3. Downtime & Interruptions
Webbuilder is not liable for downtime or service interruptions caused by:
Third-party hosting providers
Infrastructure failures
Network issues
Power outages
Maintenance windows
Software updates
Cyber incidents
Force majeure events
Load shedding
Regulatory action
Circumstances beyond reasonable control
4. Maintenance
Hosting environments may require:
Routine updates
Security patches
Emergency maintenance
Software upgrades
Such maintenance may result in temporary service interruptions without prior notice.
5. Backups & Data Responsibility
While backup systems may be implemented:
No backup system is infallible.
Restoration is not guaranteed.
Clients remain responsible for maintaining independent backups where business-critical data is involved.
6. Security Limitations
No hosting environment is completely secure.
Unless expressly included in writing:
Security monitoring is not guaranteed.
Protection against hacking, malware, or breaches is not guaranteed.
Remediation and recovery work are billable services.
7. Client Actions & Third-Party Access
Webbuilder is not liable for issues caused by:
Client modifications
External developers
Plugin conflicts
Third-party integrations
Unauthorised access
8. Suspension Rights
Webbuilder reserves the right to suspend hosting services in cases of:
Non-payment
Illegal activity
Security risk
Regulatory breach
Content that exposes Webbuilder to legal or reputational harm
9. Liability Limitation
To the maximum extent permitted by law, liability is limited to fees paid for hosting services in the preceding three (3) months.
Webbuilder shall not be liable for indirect, consequential, revenue, profit, or reputational losses.
